El presente trabajo tiene el propósito de aclarar el sentido del realismo que suscribe Charles Sanders Peirce desde su pragmaticismo. Dado que este realismo tiene sus bases en los planteamientos peirceanos concernientes a la lógica de la investigación y a su propuesta metafísica, el primer objetivo es ubicarlo en el marco de la discusión alrededor de diferentes propuestas realistas epistemológicas y ontológicas. Con base en esto, en un segundo momento, se precisará la propuesta realista que se desprende de su doctrina (...) de la continuidad o sinequismo. Finalmente, se expondrán los rasgos generales de la teleología evolutiva en la que desemboca dicha propuesta. (shrink)

De acuerdo con la crítica especializada, Aristóteles consolida el saber acumulado sobre los principios de la investigación filosófica y extrae sustancia de aquel saber para impulsar sus propios e innovadores desarrollos teórico-metodológicos, con los cuales labra y apuntala su filosofía crítica y autocrítica. La reconstrucción aristotélica de la historia crítica de la filosofía en sus cimientos y bases formativas no es en modo alguno un recuento mecánico de los desarrollos labrados por los filósofos precedentes y antecesores, sino que el filósofo (...) responde a los desafíos cognitivos que los problemas filosóficos, considerados en sí mismos, suponen e implican para el investigador que busca la verdad tanto acerca del origen del problema filosófico como acerca del origen, desarrollo y evolución de la filosofía. Mirando la tradición, para Aristóteles es claro que la filosofía ha introducido una nueva mirada sobre el mundo, la naturaleza, el ser humano y el horizonte vital de la humanidad. En la medida en que, con la tradición filosófica, contribuye a sepultar la visión mítico-religiosa, su imagen acabada, perfecta del mundo, Aristóteles contribuye también a fortalecer y robustecer la actitud y la visión científico-filosóficas que el pensamiento crítico-reflexivo viene labrando desde que fuera puesto en acto por los primeros y más tempranos filósofos. El presente artículo sostiene que Aristóteles emplea la medicina como recurso argumentativo para explicar que la imagen científica del mundo está condenada a ser incompleta, inacabada e imperfecta precisamente porque está libre del lastre dogmático del mito y porque se define, además, por su carácter crítico-experimental. Un aspecto de este cambio que conviene no tratar con negligencia es el cambio de las analogías fundamentales, que pasaron de ser arquitectónicas (...) a ser deportivas o prácticas, entre las que destaca la analogía del arquero. Nuestro objetivo en este capítulo es describir someramente dicho cambio para apuntar dos sentidos en los que creemos que la propuesta de Sosa podría «deslimitarse», es decir, desprenderse de límites que él mismo ha impuesto a su planteamiento. Un primer límite está relacionado con la dimensión temporal de la gnoseología (que, a diferencia de la ética de la creencia, habría de adoptar, según Sosa, un planteamiento esencialmente instantáneo o sincrónico). Un segundo límite es relativo a la identidad del agente epistémico, en la medida en que el planteamiento de Sosa parece asumir un enfoque individualista de difícil aplicación en casos de agentes colectivos. Sostendremos que ambos límites aparecen si mantenemos la analogía del arquero con el agente de conocimiento, al ser la suya una actividad instantánea y radicalmente individual. Si en su lugar adoptamos otras analogías para la acción epistémica, como las que aquí proponemos, salta a la vista que la sincronía y la individualidad son limitaciones contingentes para una epistemología de virtudes télica. La distinción entre contenidos conceptuales y no-conceptuales tiene claras repercusiones en el modo en que el hombre configura su mundo, así como en la posibilidad de atribuir pensamiento, en sentido estricto, a sistemas y organismos no humanos. Con el fin de clarificar dicha distinción, en el presente trabajo se plantea una noción básica de estado mental y, especialmente, una definición clara de lo que es un concepto y las características esenciales de los estados en que estos aparecen. Lo que se (...) sostiene al final es que hay buenas y suficientes razones para hablar de contenidos conceptuales y contenidos no-conceptuales, en lugar de hacerlo de contenidos más o menos conceptuales. Con Spinoza, la filosofía moderna alcanza una nueva comprensión de la subjetividad. Sobre la base de la crítica del racionalismo, Spinoza descubre, por primera vez, la afectividad para la filosofía. El filósofo reflexiona sobre la repercusión de los afectos en la formación del sujeto ético y piensa que el mayor conocimiento posible sobre los propios afectos redunda en la utilidad colectiva de la humanidad toda. Sostengo que, en la teoría general de los afectos que explica la naturaleza, principios y fundamentos (...) de los fenómenos afectivos, Spinoza anida una oportuna teoría del autoconocimiento. El proyecto filosófico kantiano se propone dar cuenta de la experiencia estética. En efecto, Kant reconstruye la tradición filosófico–formativa, elabora una crítica metodológica y problematiza la comprensión de la experiencia estética. El artículo explica, en consecuencia, cómo la estética ilustrada replantea el problema originario de la filosofía como disciplina intelectual del pensamiento científico–crítico que investiga y se empeña en reflexionar, comprender y explicar racionalmente la experiencia de lo bello. Se averigua, luego, qué rescata Kant de los aportes baumgarteanos, y se (...) descubre y expone sucintamente la teoría de la asimilación con la cual Kant sintetiza los logros teórico–prácticos de Baumgarten para integrarlos, depurados y perfeccionados, al sistema de las ciencias filosóficas. El método kantiano supera las limitaciones del método tradicional. Sostengo que el aporte kantiano a la estética como disciplina filosófica abre un nuevo horizonte de comprensión crítica en el estudio filosófico de la experiencia estética. (shrink)

Este artículo identifica los principales antecedentes legislativos y jurisprudenciales de la evidencia digital en Colombia, con miras a detallar su tratamiento en el proceso judicial; así mismo, pretende evidenciar cómo opera la cláusula de exclusión, y de qué manera se protege el derecho a la intimidad, en la obtención de evidencia digital, desde distintos medios de almacenamiento. La metodología es cualitativa y se utilizó la técnica de la revisión documental y la entrevista a expertos, para mostrar una realidad respecto a (...) una problemática de valoración de las pruebas tecnológicas, en los casos de ilicitud, y brindar aportes para mejorar la comprensión y la dimensión de su práctica en el proceso judicial. La principal conclusión es que no se le puede negar eficacia y validez probatoria por estar en forma de bytes, siempre y cuando se pueda establecer la autenticidad del contenido y la correspondencia con el autor. De récents scandales clans l'industrie du médicament ou l'agro-alimentaire ont montré les risques d'un détournement de la recherche scientifique. L'objet de ce livre est de mieux comprendre les ressorts de la crise qui s'installe ainsi entre science et société et de proposer des solutions respectant aussi bien l'indépendance de la recherche que le besoin de démocratie, très largement à inventer au demeurant, dans les choix de politique scientifique. Il s'adresse aux scientifiques comme aux citoyens. Il analyse la manière dont le (...) capitalisme néolibéral tente de mettre la science et les techniques au service de la compétitivité et des profils. Il s'appuie sur les résistances à cette politique pour montrer que la démocratie scientifique ne se résume pas à la question des choix technologiques ou de la gestion des risques et ne concerne pas la seule communauté scientifique. Il veut ouvrir des pistes pour mettre la connaissance scientifique et le développement technique au service des besoins humains (y compris le besoin de connaissances), ce qui appelle de nouvelles formes d'investissement citoyen et de pluralisme scientifique. There have been two major lines of research aimed at capturing resource-bounded players in game theory. The first, initiated by Rubinstein (), charges an agent for doing costly computation; the second, initiated by Neyman (), does not charge for computation, but limits the computation that agents can do, typically by modeling agents as finite automata. We review recent work on applying both approaches in the context of decision theory. For the first approach, we take the objects of choice in (...) a decision problem to be Turing machines, and charge players for the “complexity” of the Turing machine chosen (e.g., its running time). This approach can be used to explain well-known phenomena like first-impression-matters biases (i.e., people tend to put more weight on evidence they hear early on) and belief polarization (two people with different prior beliefs, hearing the same evidence, can end up with diametrically opposed conclusions) as the outcomes of quite rational decisions. For the second approach, we model people as finite automata, and provide a simple algorithm that, on a problem that captures a number of settings of interest, provably performs optimally as the number of states in the automaton increases. Background: Although ethics consultation has been introduced to clinical practice for many years, the results of empirical studies to evaluate the effectiveness of ethics consultation are still controversial. The design of randomised controlled trials is considered the best research design to evaluate the effect of a clinical practice on the outcomes of interests. In order to understand the effects of ethics consultation, we conducted this search for studies with the design of randomised controlled trials to evaluate ethics consultation.Objective: To provide (...) an integrated review of studies with the design of randomised controlled trials to evaluate the effectiveness of ethics consultation.Methods: PubMed was used to search for studies using the randomised controlled trial design to evaluate the effectiveness of ethics consultation. The search term used was “ethics consultation”. The selection criterion was limited to “randomised controlled trial”.Results: Four articles that met both search criteria were retrieved. One of these articles reported a study that did not actually use the design of a randomised controlled trial and is excluded from the following discussion.Conclusions: To apply randomised controlled trials to evaluate the effectiveness of ethics consultation is extremely difficult as long as two issues are not resolved: the standardisation of ethics consultation and a placebo for ethics consultation to eliminate the placebo effect. Thus, the results generated by the design of randomised controlled trials are always problematic. Furthermore, as long as the two issues exist, the results generated by the design of quantitative research methods always pose problems. (shrink)

The present study aims to elucidate whether insight problem solving could be facilitated by the cognitive component of humour. The authors take interest in whether the logical mechanisms of humour can affect how fast insight problems are solved. To that end, the authors conducted two experiments where participants solved insight problems after watching visual humorous stimuli such as videos and slideshows. The first experiment demonstrated the overall impact of facilitation by humour on insight problem solving; however, it did not show (...) any difference in how particular logical mechanisms of humour affect the solution time of insight problems. The second experiment showed that the cognitive component of humour could selectively affect insight problems whose difficulty stems from different sources. These results suggest that the cognitive component of humour, when operationalised as logical mechanisms and schema switching, contributes to solving insight problems. (shrink)

Following Henkin’s discovery of partially-ordered (branching) quantification (POQ) with standard quantifiers in 1959, philosophers of language have attempted to extend his definition to POQ with generalized quantifiers. In this paper I propose a general definition of POQ with 1-place generalized quantifiers of the simplest kind: namely, predicative, or “cardinality” quantifiers, e.g., “most”, “few”, “finitely many”, “exactly α ”, where α is any cardinal, etc. The definition is obtained in a series of generalizations, extending the original, Henkin definition first to a (...) general definition of monotone-increasing (M↑) POQ and then to a general definition of generalized POQ, regardless of monotonicity. The extension is based on (i) Barwise’s 1979 analysis of the basic case of M↑ POQ and (ii) my 1990 analysis of the basic case of generalized POQ. POQ is a non-compositional 1st-order structure, hence the problem of extending the definition of the basic case to a general definition is not trivial. In this article I argue that textual evidence from David Hume's A Treatise of Human Nature does not support J. Baird Callicott's professedly Humean yet holistic environmental ethic, which understands the community (e.g., the biotic community) as a ‘metaorganismic’ entity ‘over and above’ its individual members. Based on Hume's reductionist account of the mind and his assimilation of the metaphysical nature of the mind to that of the community, I also argue that a Humean account of the community should be (...) likewise reductionist. My conclusion is that Callicott's anti-reductionist holism is at least foreign to, and at worst incompatible with, Hume's philosophy. (shrink)

In presence of predator population, the prey population may significantly change their behavior. Fear for predator population enhances the survival probability of prey population, and it can greatly reduce the reproduction of prey population. In this study, we propose a predator-prey fishery model introducing the cost of fear into prey reproduction with Holling type-II functional response and prey-dependent harvesting and investigate the global dynamics of the proposed model. For the system without harvest, it is shown that the level of fear (...) may alter the stability of the positive equilibrium, and an expression of fear critical level is characterized. For the harvest system, the existence of the semitrivial order-1 periodic solution and positive order- q periodic solution is discussed by the construction of a Poincaré map on the phase set, and the threshold conditions are given, which can not only transform state-dependent harvesting into a cycle one but also provide a possibility to determine the harvest frequency. In addition, to ensure a certain robustness of the adopted harvest policy, the threshold condition for the stability of the order- q periodic solution is given. Meanwhile, to achieve a good economic profit, an optimization problem is formulated and the optimum harvest level is obtained. Mathematical findings have been validated in numerical simulation by MATLAB. Different effects of different harvest levels and different fear levels have been demonstrated by depicting figures in numerical simulation using MATLAB. (shrink)

In Metaphysics E. 3. 1027a29–30 Aristotle states that there are some causes, the incidental ones, that are generable and destructible but they have no coming to be. Furthermore, he asserts that if we deny this thesis, then we will have to give into determinism (1027a30–32). There are three persistent puzzles surrounding this chapter. First, what does it mean to say that a cause is generable and destructible but it has no coming to be? Second, what exactly is the connection between (...) this claim and determinism? And third, if we accept that in Metaphysics E. 3 Aristotle deals with incidental causation, then how is this discussion related to the treatment of incidentalness in E. 2? This article puts forward answers for these puzzles. I argue that there is textual evidence in Physics II. 5 that shows that the claim in Metaphysics 1027a29–30 is meant to capture the non-teleological nature of incidental causation. Moreover, I argue that this same textual evidence indicates that the thesis expressed at Metaphysics 1027a29–30 is in effect Aristotle’s response to teleological determinism. Finally, I suggest that it is plausible to suppose that chapter 3 does not quite belong with the rest of Metaphysics E. (shrink)

Recent developments in the health care industry have precipitated a new wave of interest in expanding the scope of practice for nursing. This is because the Patient Protection and Affordable Care Act, broadly designed to increase access to health insurance, will inevitably result in increased demand for primary care providers. And with compensation for primary care physicians already lagging far behind that of specialists, the role of nurse practitioners is once again receiving increased attention as a viable means by which (...) to ease the pressure for access to health care.But the economics of this trade-off are controversial. On one hand, it sets primary care physicians at odds with specialists; namely, if the ultimate goal is to “bend the cost curve downward,” should specialist compensation be reduced in order to increase spending on primary care? Obesity is a particularly vexing public health challenge, since it not only underlies much disease and health spending but also largely stems from repeated personal behavioral choices. The newly enacted comprehensive health reform law contains a number of provisions to address obesity. For example, insurance companies are required to provide coverage for preventive-health services, which include obesity screening and nutritional counseling. In addition, employers will soon be able to offer premium discounts to workers who participate in wellness programs that emphasize (...) behavioral choices. These policies presume that government intervention to reduce obesity is necessary and justified. Some people, however, argue that individuals have a compelling interest to pursue their own health and happiness as they see fit, and therefore any government intervention in these areas is an unwarranted intrusion into privacy and one's freedom to eat, drink, and exercise as much or as little as one wants. This paper clarifies the overlapping individual, employer, and social interest in each person's health generally to avoid obesity and its myriad costs in particular. The paper also explores recent evidence on the impact of government interventions on obesity through case studies on food labeling and employer-based anti-obesity interventions. Our analysis suggests a positive role for government intervention to reduce and prevent obesity. At the same time, we discuss criteria that can be used to draw lines between government, employer, and individual responsibility for health, and to derive principles that should guide and limit government interventions on obesity as health reform's various elements (e.g., exchanges, insurance market reforms) are implemented in the coming years. The difference between the two is both substantial and significant; it is the difference between the rule of arbitrary power and the rule of law. This paper will seek to trace the genesis of an independent judicial power, in both theory and practice, through an examination of sections of The Constitutions of Clarendon, The Assize of Clarendon, Hobbes’ Leviathan, Locke’s Second (...) Treatise, Montesquieu’s Spirit of the Laws, as well as The Federalist Papers. Moreover, it will seek to establish its executive nature and to explain why it is so often (at least presently) misunderstood to be akin to the legislative power. (shrink)

The image of nature as causality has been a major theme of science and poetry. It has been a symbol of hope and fear, of progress and futility. Yet its meaning has seldom been clear. Prior to any statement about the relation of causality to physical nature, life, and mind, its meaning should be established. I shall therefore first define causality, and I shall then discuss its applicability to nature.

Societies are composed of groups that interact. Symbiotic groups are those in which agents complement each other in resources that they have in excess. Symbiotic groups are useful especially when the resources in an environment are distributed unevenly, because they enable agents to trade resources easily. However, for trading to happen successfully, agents in symbiotic groups need to cooperate, i.e., they should be willing to donate resources when appropriate. Similarly, if some agents in a symbiotic group are defectors, they should (...) be identified by others and eliminated from the group for the well-being of the remaining agents. Accordingly, we first study Edmonds’ tag-based model of symbiotic groups to understand the lifespan of symbiotic groups (e.g., why some groups live shorter than others). Then, we enhance Edmonds’ model by adding the capability of reciprocal interactions to agents, thus achieving a hybrid model. We capture reciprocity in three different models and study their effects on the elimination of defectors in symbiotic groups. Our experimental results show that the groups that are built with the proposed hybrid model can eliminate more defectors and earlier than tag-based models. Further, the hybrid approach can generate symbiotic groups more effectively and efficiently. (shrink)

Context: A growing number of Japanese people have completed advance directives, especially living wills, even though there is no legislation recognising such documents and little empirical research on their impact on clinical care at the end of life in Japan.Objectives: To investigate physicians’ attitudes about living wills and their experiences with patients who had completed a living will and later died.Design: Self administered survey and qualitative study using open question and content analysis.Setting: Japan.Participants: Physicians known to have cared for a (...) patient who had presented a living will prior to death.Measurements: The physician’s response to receiving a living will, communication about the living will, the impact of the living will on clinical care, demographics, and their opinion on advance directives, especially living wills.Main results: Fifty five per cent of respondents approved of advance directives in general, and 34% had more opportunities to communicate with a patient and his/her family after receiving the living will. Sixty nine per cent of the physicians who received a living will did not, however, change their course of therapy as a consequence of receiving the living wills. Based on the analysis, we identified three areas of concern in the comments on living wills: concerns relative to patients, physicians, and families; social context, and clinical and administrative concerns. The physicians raised various topics for discussion; they tended to describe the issues from a clinical perspective.Conclusions: Our identified areas of concern should prove helpful in better understanding the clinical and ethical implications of living wills in Japan. In recent years, the homeless population has received much attention as authorities attempt to comprehend this phenomenon and offer solutions. When striving to establish a relationship with the homeless person, many problems arise. We encounter this dilemma when respecting the right of the mentally ill to dwell neglected in the streets and simultaneously observe their inability to comprehend provisions such as housing, shelter, medical and mental care which contribute to their human dignity. Utilitarianism focuses on the optimization of personal well being in ways that seems to make the practice of medicine irrelevant to the well being of the practitioners, unless given external incentives such as money or honor. Care based on indirect incentives is considered inferior to care motivated internally. This leads to the paradox of utilitarian care. Following Nozick's conceptual Pleasure Machine it is argued that in addition to the promotion of personal well being, people care about fulfilling their well being (...) in a world which is real, just, good, and beautiful. Complete mechanization of social and personal life in accordance with a strict utilitarian regime is also incompatible with the kind of world people desire, even if it promises more fulfillments in terms of personal well being. This explains the so-called Taurek-Parfit paradox, according to which sometimes ethics seems “to count the numbers” and sometimes not. The very pursuit of utilitarianism does not contribute to any personal life plan. The helping professions make the world a better place for us to live in, even though they do not necessarily bear directly on the well being of any individual other than the recipients of care. For many centuries Jews in Arabic-speaking lands have transcribed books written by non-Jews into the Hebrew alphabet; the language remains Arabic, but the writing is Hebrew. This was done mainly for the benefit of those who knew the Arabic language but not the script. The majority of these transcriptions are scientific or philosophical texts. Transcriptions are of value to scholars for two reasons. Some entire texts, or more complete or accurate versions of texts, are preserved only in transcription. In addition, (...) the choice of texts transcribed is very instructive concerning the cultural and intellectual interests of Jews. A century ago the great bibliographer Moritz Steinschneider published a description of the transcriptions known to him. We have undertaken to prepare a full catalogue. In this article we offer a preliminary relisting of those manuscripts that we have examined recently. (shrink)
